which project have been eliminated, are under consideration, or will occur.

 

Cognis is not required to actually proceed with any pollution prevention project although other facilities have saved money through such projects.  However, if Cognis fails to comply in the future, US EPA, Ohio EPA, or the City of Cincinnati could impose a project on the facility in lieu of a

fine.  The Pollution Prevention Study will be a public document so community members and public interest groups could also use the study to initiate a campaign to

have Cognis adopt some of the pollution prevention measures. 

 

These fines follow on the heels of other environmental enforcement actions at Cognis:

¨ In 2006, the City of Cincinnati, citing a total of 129 air quality complaints the previous year, found that Cognis odors constituted a public nuisance and assessed a fine of $25,000 with 5,000 of that fine going to Winton Montessori School which had been affected by a severe pollution incidents.  

¨ Also in 2006, Cognis was fined $400,000 for violating the Clean Water Act and the

 

 

 

 

Migratory Bird Treaty Act in a spill in the Mill Creek which killed fish and Wildlife. In addition, Cognis also agreed to pay the Ohio Department of Natural Resources $9,994.67 as restitution for the fish kill.
